Service-Disabled Veteran-Owned Small Business (SDVOSB)

On December 22, 2006, Public Law P.L. 109-461 was enacted to establish additional procurement mechanism for the Veterans Affairs to sole source contracts to Service Disabled Veterans Owned Small Business (SDVOB) up to $5 million. When Public Law 109-461 takes effect on June 20, 2007, sourcing priority for VA procurements will be awarded with service-disabled small veteran-owned businesses (SDVOB) as the top order of preference. According to the VA's Center for Veterans Enterprise, the VA May direct source to a SDVOB below the Simplified Acquisition Threshold (SAT) to eligible firms. FlowSense's set-aside status and the benefits of this new legislation offers our company an unprecedented chance to grow the federal government business at the Department of Veterans Affairs.

THE VETERANS BENEFITS ACT OF 2003
To enhance business opportunities for Service-Disabled Veteran-Owned Business (SDVOSB) entities, Congress has enacted P.L. 108-183: the Veterans Benefits Act of 2003. P.L. 108-183 enables SDVOSB firms to receive sole source and restricted competition contracts for goods and services used by the U.S. Government. The anticipated award of sole source contracts will not exceed $5M for manufacturing and $3M for other contract opportunities. Congress enacted this statute after data collection from more than 60 federal departments and agencies showed that more than half of them reported no procurement dollars expended with SDVOSBs.

8(a) and Small Disadvantaged Business (SDB) Certification

Section 8(a) of the Small Business Act, as amended, authorizes SBA to contract for goods and services with federal agencies. SBA then subcontracts actual performance of the work to socially and economically disadvantaged small businesses, which have been certified by SBA as eligible to receive these contracts. The major advantage of this program is that it allows the government to contract, on a noncompetitive basis.

  • FlowSense can be awarded individual sole-source (non-competitive) Federal government contracts up to $3 million for goods & services and $5 million for manufacturing.
  • FlowSense may receive up to $100 million in sole source contracts during the program participation (nine years) .
  • FLowSense may compete for procurements over $3 million (or $5 million for manufacturing) that are set aside for competition only by 8(a) certified firms which greatly reduces the field of competition.
  • FlowSense, as a certified Small Disadvantaged Business, can receive a price evaluation preference of 10% on full and open competitive procurements for submitted bids.
  • Federal acquisition policies encourage Federal agencies to award a certain percentage of their contracts to Small Disadvantaged Businesses. To speed up the award process, the SBA has signed Memorandums of Understanding (MOUs) with 25 Federal agencies allowing them to contract directly with certified 8(a) firms.
  • Recent changes permit 8(a) FlowSense to form joint ventures and teams to bid on contracts. This enhances the ability of FlowSense to perform larger prime contracts and overcome the effects of contract bundling (the combining of two or more contracts together into one large contract).
State of Minnesota Certifications
  • DBE (Disadvantaged Business Enterprise) – Recognized by Metropolitan Airport Commission, Metropolitan Council, and MN Department of Transportation. DBE receives a set aside percentage of a building or construction project from local and federal government agencies.
  • State of Minnesota Targeted Group Vendor – This designation provides for a price adjustment of 6% compared to a business without this designation.
  • CERT Program – The Central Certification is a small business certification recognized by the cities of Minneapolis, St. Paul, Hennepin, and Ramsey Counties.
